Civil procedure used for enforcement of EC competition law by the English, French, and German civil courts.
While some harmonization concerning the procedural rules of European competition law has taken place, diversity remains concerning the rules governing the bringing of the claim, those applicable to the principles that underlie the trial, those applicable to the function of the judge, those relevant to the collecting and use of evidence, and those concerning the assessment and compensation of prejudice. These differences are discussed in this comparative treatment of the relevant procedural rules used by English, French, and German civil and commercial courts in civil litigation involving articles EC 81 and 82. Competition law and economics; advances in competition policy and antitrust enforcement.
The First Lisbon Competition Law and Economics proceedings were held in 2005 to take a critical look at EC regulation in the European Union, and to address competition abuses in the marketplace. Mateus and Moreira (Portuguese Competition Authority) have edited these papers of the event to document how decisions were made regarding special powers of investigation, leniency programs, individual sanctions, the impact of regulation and the costs of enforcing these policies. Judicial reviews of EC merger decisions are also evaluated in this book, which is aimed at judges, academics and practitioners who work within the EC system. Economic development through world trade; a developing world perspective.
Unsurprisingly, there remains quite a gap in perceptions concerning development and trade between the developed and the developing world, a gap that Lee (St. John's U. School of Law) suggests was partly responsible for the recent stalling of the Doha Round of trade negotiations convened by the World Trade Organization. In an attempt to bridge this gap, he presents 13 papers from scholars and professionals from different areas of the developing world on various issues of world trade and economic development. Topics include a proposal for the Agreement on Development Facilitation and the Council for Trade and Development in the WTO; a reflection on the south-south coalition in the last half-century from the perspective of international economic law-making; the WTO, democracy, and development; liberalization of trade in services and trade negotiations; the reclamation of the development content of the WTO Doha Round; the interaction in the Americas between trade diplomacy and development clubs. Also included are case studies of trade and development that discuss South Korea, China, India, Iran, Turkey, Uganda, and Ukraine. Distributed in North America by Aspen Publishers, Inc.
