Produced under the auspices of the American Bar Association's Section on Antitrust Law, this is the sixth edition of a legal commentary intended to synthesize the statutes, court decisions, enforcement actions, agency regulations, guidelines, and other materials of antitrust law into a coherent statement of the governing legal rules for the benefit of the bar, the judiciary, and students of law. For the new edition, the chapter on monopolization has substantially rewritten to accommodate changes in the courts' analysis of single-firm conduct, analysis of state antitrust laws have been afforded a separate chapter, treatment of civil government enforcement and criminal antitrust enforcement has been separated into two separate chapters, a new separate chapter provides an overview of consumer protection laws, and discussion of international antitrust issues has been significantly expanded. This guide is designed to encourage the exchange of information among agencies, and can be used as a starting point for discussion or further research on administrative law issues pertaining to agency rulemaking. This fourth edition brings the Guide up to date with respect to recent cases and changes introduced by the Bush II administration. Part I is an overview of federal agency rulemaking, describing the major institutional players and historical development. Part II describes the statutory structure of rulemaking, including the relevant sections of the Administrative Procedure Act and other statutes that have an impact on present-day rulemaking. Part III contains a step-by-step description of the informal rulemaking process, from preliminary considerations to the final rule. Part IV discusses judicial review of rulemaking. Appendices offer key rulemaking documents. While the Guide continues to emphasize court decisions in the area of informal rulemaking, it is not intended to be a complete catalog of relevant cases. The Raise the Bar project, conducted by the American Bar Association Section of Litigation, sought to figure out why lawyers were leaving the profession in high numbers.
